Sarah V. Pérez, Esq. presented oral arguments before the Ninth Circuit Court of Appeals on the issue of whether a conviction pursuant to California Penal Code section 288(c) constitutes a crime involving moral turpitude. Ultimately, the Ninth Circuit held in a published opinion that it does not.

Sarah V. Pérez, Esq. presented oral arguments before the Ninth Circuit Court of Appeals on issues relating to eligibility for asylum and whether or not her client’s procedural entry into the United States constituted a lawful entry pursuant to Matter of Quilantan, 25 I&N Dec. 285 (BIA 2010), including arguments relating to violations of his due process rights before the Immigration Judge.

Sarah V. Pérez, Esq. presented oral arguments before the Ninth Circuit Court of Appeals on issues relating to eligibility for withholding of removal and protection under the Torture Convention. Specifically, the arguments centered on imputing the past persecution of family members that occurred in the country of origin and while the Petitioner was residing in the United States. The arguments also focused on claim exhaustion and whether or not a claim was actually exhausted when presented before the Immigration Judge and where the Board of Immigration Appeals acknowledges/dismisses the argument on other grounds.
